Capacity-Building – Intellectual Property and Traditional Knowledge

It may seem, at first glance, that WIPO’s work on intellectual property (IP) and traditional knowledge (TK), traditional cultural expressions (TCEs) and genetic resources (GRs) concerns mainly the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC). But, in fact, WIPO’s extensive capacity-building program occupies most of its Traditional Knowledge Division’s time!

Amidst growing concerns over the continued misappropriation of TK, GRs and TCEs, stakeholders wish to take the practical and immediate steps available to them now to protect and derive benefit from these valuable resources. Such steps include using existing IP systems to the extent possible, creating policies and special legal measures, developing cultural protocols and model contracts and establishing effective institutions. These are the kinds of requests for capacity-building that WIPO receives.

WIPO’s range of unique policy materials and specialized practical tools in the area of TK, TCEs and GRs – including guidelines, toolkits, training programs and databases – is in great demand, and this demand is growing and diversifying. Government officials, indigenous and local communities, non-governmental organizations (NGOs) and research and cultural institutions from around the world all benefit from this capacity-building program, which draws from a wide portfolio of expertise, practical experience and collaboration in the field. The program remains rooted in the needs and expectations identified by the Organization during its 1998 and 1999 fact-finding missions.

Provided upon request, WIPO’s assistance includes facilitating national and regional consultations, providing legislative and policy guidance, organizing study visits, undertaking research and offering support for awareness raising and training.

Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) 1. ภูมิหลัง 1.1 การประชุม Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) ครั้งแรกจัดขึ้นเมื่อปี 2544 ณ สำนักงานใหญ่ WIPO นครเจนีวา โดยมีวัตถุประสงค์เพื่อหารือเกี่ยวกับร่างบทบัญญัติเพื่อคุ้มครองภูมิปัญญา ท้องถิ่นประเภทต่างๆ ได้แก่ (1) ทรัพยากรพันธุกรรม (Genetic Resources) อาทิ พันธุ์พืชต่างๆ (2) องค์ความรู้ของชุมชนท้องถิ่น (Traditional Knowledge) อาทิ การแพทย์แผนโบราณ นวัตกรรมท้องถิ่น และ (3) ศิลปวัฒนธรรมพื้นบ้าน (Folklore/Traditional Cultural Expressions) อาทิ ศิลปะท้องถิ่น ความเชื่อ ดนตรีพื้นเมือง 1.2 เนื่องจากการประชุม IGC ยังไม่สามารถหาข้อสรุปเกี่ยวกับประเด็นภูมิปัญญาท้องถิ่นเหล่านี้ได้ เนื่องจากแนวคิดที่ไม่ตรงกันระหว่าง (1) ประเทศกำลังพัฒนาและกลุ่มชนพื้นเมืองดั้งเดิม (indigenous people) ซึ่งต้องการผลักดันให้มีการคุ้มครองภูมิปัญญาท้องถิ่น โดยต้องการให้มีระบบกฎหมายเฉพาะ (sui generis) ที่มีผลผูกพันระหว่างประเทศ โดยกฎหมายเหล่านั้นควรกำหนดให้มีการเปิดเผยแหล่งที่มาของภูมิปัญญาท้องถิ่น (disclosure of origin) การได้รับความยินยอมก่อนที่จะเข้าถึง (prior informed consent – PIC) และการแบ่งปันผลประโยชน์จากการใช้ภูมิปัญญา (access and benefit sharing – ABS) และ (2) ประเทศพัฒนาแล้วซึ่งต้องการนำภูมิปัญญาเหล่านั้นไปใช้ประโยชน์ และเห็นว่าการมีกฎหมายที่มีผลผูกพันระหว่างประเทศต้องศึกษาให้รอบคอบ และต้องการให้การประชุม IGC เป็นเพียงเวทีแลกเปลี่ยนประสบการณ์การทำงานด้าน GRTKF ในแต่ละประเทศเท่านั้น 1.3 ในการประชุม IGC ครั้งที่ 14 ระหว่างวันที่ 29 มิถุนายน – 3 กรกฎาคม 2552 ณ สำนักงานใหญ่ WIPO นครเจนีวา ประเทศกำลังพัฒนาเรียกร้องให้มีการต่ออาณัติการประชุม IGC ออกไปอีก 2 ปี แบบมีเงื่อนไข อย่างไรก็ดี ไม่สามารถตกลงกันได้ จนกระทั่งมีการนำมาพิจารณาในการประชุมสมัชชาใหญ่ WIPO ระหว่างวันที่ 22 กันยายน – 1 ตุลาคม 2552 ซึ่งที่ประชุมได้มีมติให้ต่ออาณัติ IGC โดยมีเงื่อนไข ได้แก่ (1) ให้มีกรอบระยะเวลาที่ชัดเจน โดยให้มี intersessional working group (IWG) (2) ให้มีการเจรจาแบบรายข้อบท (text-based negotiations) (3) ให้นำไปสู่ international legal instrument(s) 1.4 อย่างไรก็ดี ในการประชุม IGC ครั้งที่ 15 ระหว่างวันที่ 7-11 ธันวาคม 2552 ที่ประชุมฯ ยังไม่สามารถตกลงกันได้เรื่องรูปแบบของ (IWG) ซึ่งจะนำไปพิจารณาในที่ประชุม IGC ครั้งที่ 16 ต่อไป 2. ท่าทีไทย ไทยสนับสนุนให้มีการคุ้มครองภูมิปัญญาท้องถิ่นในระดับระหว่างประเทศ ในรูปแบบ international legal instrument(s) โดยให้มีการจัดตั้ง interessional working group ภายใต้ IGC โดยเน้นหลักความโปร่งใสและความมีประสิทธิภาพ นอกจากนี้ ไทยได้เรียกร้องให้ทุกฝ่ายมีความยืดหยุ่นในเรื่องดังกล่าวเพื่อให้สามารถ บรรลุวัตถุประสงค์ดังกล่าวได้ นอกจากนี้ เห็นว่า WIPO ควรให้การสนับสนุนประเทศกำลังพัฒนาในการเตรียมความพร้อมในเรื่องดังกล่าว โดยเฉพาะอย่างยิ่งในการจัดทำกฎหมายภูมิปัญญาท้องถิ่นระดับชาติและการทำฐาน ข้อมูลภูมิปัญญาท้องถิ่น ************************* กองนโยบายเศรษฐกิจระหว่างประเทศ กรมเศรษฐกิจระหว่างประเทศ 11 มกราคม 2553

Intergovernmental Committee

Established by the WIPO General Assembly in October 2000 (document WO/GA/26/6), the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) is undertaking text-based negotiations with the objective of reaching agreement on a text of an international legal instrument (or instruments) which will ensure the effective protection of traditional knowledge (TK), traditional cultural expressions (TCEs)/folklore and genetic resources. His attempt to overcome his poverty in the streets of Sidi Bouzid, central Tunisia, was halted by a police officer who seized his goods, claiming that Al Bouazizi was working without the necessary legal permit.

The exact reasons behind Al Bouazizi's subsequent outrage are not clear. Some observers allege that the police officer slapped him across his face; others that Al Bouazizi tried to complain at a center for unemployed graduates -- but that no one listened to him and he heard only laughter and insults.

Whatever his intentions, Muhammad Al Bouazizi's actions changed Tunisian history.

Under the terms of the accord reached on Thursday between President Nicolas Sarkozy and Chancellor Angela Merkel, Athens would, in the event of "very serious difficulties", receive co-ordinated bilateral loans from its eurozone partners as well as ……………….assistance. The majority of the money would come from the eurozone. Loans would be provided at "unsubsidised" interest rates.

(CNN) -- The top U.N. humanitarian official in Somalia has fired back at a report that suggests food aid is being skimmed off by contractors as "a cost of doing business" in the war-torn nation, an allegation he calls "completely misleading."

"This is far from the case," Mark Bowden, the U.N. resident coordinator for Somalia, wrote in a response to the report.

"While U.N. humanitarian organizations recognize that they are working in a complex environment where a war economy has predominated for many years, rather than succumbing with an implied spirit of fatalism to this environment, U.N. agencies and other humanitarian organizations have introduced new measures and approaches to ensure effective management of humanitarian assistance."

วัตถุประสงค์ของการก่อตั้ง IMF คือ จัดการและควบคุมระบบการเงินของโลกและช่วยเหลือประเทศที่เผชิญกับวิกฤต เศรษฐกิจ โดยจะประสานการทำงานกับกระทรวงการคลัง และแบงก์ชาติของแต่ละประเทศ หน้าที่หลักของ IMF มีอยู่ 3 ประการคือ

1. จัดระบบการเงินโลก
2. กำกับกติกาทางเศรษฐกิจของโลก เพื่อให้เกิดความมั่นคงมีเสถียรภาพ
3. สร้างเงินซึ่งเป็นเงินสำรองระหว่างประเทศ เป็นเงินที่เป็นกลาง ไม่ได้เป็นเงินของประเทศใดประเทศหนึ่ง
